Terms of Service

1. Scope and Provider

These terms of service (“Terms”) govern the use of the wep4budget budget planning platform (“Service”) provided by:

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

3. Service Description

wep4budget is a cloud-based budget planning platform offered as Software as a Service (SaaS). The specific features available depend on your subscription tier:

  • Basic — Budget planning (expenses), Excel import, reports & dashboards, document upload (fair use), EU data sovereignty, platform encryption
  • Standard — All Basic features plus revenue budgeting, AI assistant (managed models), advanced data import, document upload (fair use)
  • Premium — All Standard features plus premium AI models, own AI provider key, backup & restore, BYOC zero-trust encryption, document upload (fair use)
  • Enterprise — Configurable feature set with dedicated infrastructure

4. Subscription and Billing

  • Subscriptions are billed monthly at a fixed price based on your team size and tier.
  • Team sizes: S (up to 10 users), M (up to 25 users), L (up to 50 users), Enterprise (unlimited, custom pricing). See Pricing.
  • Shared accounts (multiple people using one login) are not permitted. Each user must have their own account.
  • All prices are in EUR and exclude applicable VAT.
  • Payment is processed via Stripe. You authorize recurring charges to your payment method.
  • AI usage (Standard and Premium tiers with managed models) is billed separately at 2× provider cost, based on actual token consumption.
  • Premium subscribers may use their own AI provider API key (“Own AI Key”), in which case AI usage is billed directly by the provider with no markup from wep4budget.
  • You can upgrade, downgrade, or cancel at any time. Changes take effect at the next billing period.
  • Refunds are not provided for partial billing periods, except where required by law.

5. Your Data

You retain full ownership of all data you enter into the Service (“Customer Data”). We do not claim any intellectual property rights over your content. Specifically:

  • You can export your data at any time in standard formats.
  • Upon account deletion, all Customer Data is permanently removed within 30 days.
  • We process Customer Data solely to provide the Service, as described in our Privacy Policy.
  • Each tenant’s data is stored in an isolated database — your data is never mixed with other customers’ data.

6. Availability and SLA

We strive for 99.9% uptime for the Service, measured monthly (excluding scheduled maintenance). Planned maintenance windows will be announced at least 48 hours in advance via email. Enterprise customers may negotiate a formal Service Level Agreement (SLA) as part of their contract.

7. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of applicable laws
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Reverse-engineer, decompile, or disassemble any part of the Service
  • Resell or sublicense access to the Service without written permission
  • Upload malicious content, viruses, or interfere with other users’ use of the Service
  • Use the Service to store data unrelated to budget planning without prior agreement

8. Limitation of Liability

To the maximum extent permitted by Austrian law (ABGB, KSchG):

  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
  • We are not liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities.
  • This limitation does not apply to damages caused by gross negligence or willful misconduct, or to liability that cannot be excluded by law.

9. Data Protection

We process personal data in accordance with our Privacy Policy and the EU General Data Protection Regulation (GDPR). For Enterprise customers and organizations requiring a Data Processing Agreement (DPA), we provide one upon request at office@wep4budget.eu.

10. Termination

  • You may cancel your subscription at any time. Service continues until the end of the current billing period.
  • We may suspend or terminate accounts that violate these Terms, with reasonable notice where possible.
  • Upon termination, you have 30 days to export your data before it is permanently deleted.
  • Provisions that by their nature should survive termination (e.g., limitation of liability, governing law) will remain in effect.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days in advance via email. Continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you may cancel your subscription before the effective date.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Austria, excluding its conflict of law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply. For consumers within the EU, mandatory consumer protection laws of your country of residence may additionally apply. Place of jurisdiction is Vienna, Austria, unless mandatory law provides otherwise.
